Governor Live Review: Leading or joining a MAT – the legal issues

The eighth Governor Live event of 2017 – Leading or joining a MAT – the legal issues – took place on the evening of Thursday evening, the 25th of May.  Michelle Gray, employment partner and head of Education at berg and her colleague Darren Ashworth, a solicitor on berg’s Real Estate team, spent half an hour exploring some of the issues around:

  • What is an academy?
  • What does an academy conversion involve?
  • Setting up a MAT / Joining an existing MAT
  • Questions to ask when joining a MAT
  • Trustees / Members / Key documents
  • TUPE
  • Land issues: Due diligence & potential legal issues

This was then followed by our usual time of questions and discussion – the recording of which and slides from are below.

  • What are the implications regarding land for VA schools?
  • Is it considered appropriate to have the Chief Executive on the the board to which he/she is accountable? I seem to hear conflicting advice.
  • For a school in a MAT who would Ofsted speak to in terms of governance?
  • Who appoints the members? Can members be removed?
  • Can a member can sit on the trust board?

The final Governor Live session: Performing a SWOT analysis on your school

On Thursday the 15th of June at 8pm Christine Bayliss of C:BECS – who has presented in previous Governor Live events including our Considerations for Conversion series – will be presenting the final Governor Live session of the spring and summer terms entitled Performing a SWOT analysis on your school. Here’s her introduction to this session:

“This Governor Live event will be a workshop for governors of maintained schools and standalone academies on how to carry out a SWOT analysis of their institution, to help make informed decisions regarding joining or leading a MAT. We’ll be using anonymised data from a currently maintained school, and participants will be encouraged to critically assess the information and come to their own conclusions about how the school might best proceed when faced with the prospect of academisation in whatever form – or not at all.

We’ll examine how taking an objective view of how our school’s ethos,  its academic data, its situation in terms of finance & resources, along with the wider pattern of provision in the local area can help governors make informed and sensible decisions about how to approach the prospect of academisation.

As ever, there’ll be time for questions, reflection and interaction with your fellow governors throughout the session.”
